Section 12006(a) of the 21st Century Cures Act requires states to use EVV for all Medicaid-funded personal care and home health care services. While some Illinois Managed Care Organizations (MCOs) already enforce these rules, the mandate expands to all State Plan home health care service providers starting April 1, 2026.

The state tracks compliance by reviewing the EVV data associated with your Medicaid claims. HFS expects your agency administrators to monitor caregivers closely, ensuring they clock in and out correctly using an approved mobile application. Understanding Thresholds and Penalties

HFS enforces compliance through a strict quarterly review process. They monitor the percentage of your visits that successfully meet all EVV criteria without manual intervention.

The Compliance Targets

Agencies receive a slight grace period as the new 2026 rules take effect. For the first six months, your agency must maintain a minimum compliance rate of 50%. After the first year, the state raises this threshold to 75%. Falling below these marks triggers a three strike system, which can then lead to audits!

Strike Three: A third consecutive failure results in a direct referral to the Office of the Inspector General (OIG) for investigation.
